Terms of Service

Makefanly is a global monetization platform for content creators, operationally based in Brazil. We let creators ("creators") sell subscriptions and one-off content to their fans ("fans", "users") in any country, through payment links, a post feed and monthly subscriptions, accepting both Pix (Brazil) and USDC (stablecoin, international payment). By creating an account or using Makefanly in any way, you agree to these Terms of Service and to our Privacy Policy.

You need a valid email and a password to sign up. You are responsible for keeping your password confidential and for all activity on your account. You must be at least 18 years old to sign up as a creator or fan on Makefanly, regardless of your country of residence. We do not allow fake accounts, automated (bot) accounts, or accounts impersonating another person.

Creators must choose a public "handle" (e.g. makefanly.com/your-handle), used to access their public page. We reserve the right to remove handles that infringe trademarks, are offensive, or impersonate another person or company.

Creators freely set the price of their payment links (paylinks) and monthly subscription, in Brazilian reais or USDC. Fans in Brazil typically pay via Pix; fans anywhere else pay via USDC. We are evaluating adding international credit card payments through a third-party payment processor, to reach fans who prefer paying by card.

Free plan: the creator receives 100% of the price they set for each sale. A 15% convenience fee is charged to the fan, added to the price at checkout -- it is not deducted from the amount the creator receives.

Premium plan: through a monthly subscription paid by the creator, the 15% convenience fee stops being charged to fans on all of that creator's purchases.

USDC payments: stablecoin transactions are processed by a smart contract that splits the payment between the creator and Makefanly automatically, within the same on-chain transaction. Makefanly never custodies the fan's funds -- the contract transfers directly from the fan's wallet to the creator and to Makefanly. This is the recommended payment method for fans outside Brazil.

Pix payments are processed by partner payment institutions. Since Pix is an instant, irreversible payment method, confirmed Pix payments are not automatically refunded, except in cases of proven fraud, at Makefanly's and the partner institution's discretion.

To withdraw amounts received in reais, the creator must register their CPF (Brazilian tax ID), which automatically becomes their Pix withdrawal key. For security and fraud-prevention reasons, the registered CPF cannot be changed through self-service once saved -- changes require contacting support and proof of identity. The same applies to the USDC payout wallet: once registered, it stays permanently tied to the creator's account.

Amounts received via Pix become available for withdrawal after a short holding period, used to cover any payment disputes before releasing the balance.

Creators can refer other creators through a personal referral link. This is a limited-time launch promotion -- Makefanly may modify or end it at any time, without retroactive effect on commission already credited as of the change date. Under current terms: the referrer earns 5% of the referred creator's net earnings while she's on the free plan, or 30% of her monthly fee if she subscribes to the premium plan -- in both cases, commission is calculated on the revenue Makefanly actually retains from the referred creator, never on her gross earnings. Commission is valid for 12 months from the referred creator's signup and is subject to a cap of R$100,000 (one hundred thousand reais) per referred creator. Amounts credited as commission follow the same holding and withdrawal periods that apply to other amounts received on the platform (see section 4).

The creator retains ownership of the content they publish on Makefanly. By publishing, the creator grants Makefanly a license to host, process, display and deliver that content to fans who paid for it or hold an active subscription, strictly to operate the service -- this license does not survive account closure or the creator deleting the content.

The creator represents and warrants that they hold all necessary rights over published content (including authorization from anyone appearing in it) and that the content does not violate applicable law or third-party rights.

Zero tolerance for the exploitation of minors. Publishing, soliciting, or sharing any content involving anyone under 18 in a sexual or exploitative context, in any form, including digitally generated or manipulated material, is strictly prohibited. Accounts involved are banned immediately and reported to the relevant authorities. If you find this kind of content on Makefanly, report it immediately to security@makefanly.com, with as much detail as possible (link, date/time, description).

Non-consensual content is prohibited. All content must depict only people who expressly consented to being recorded and to that specific content being published on Makefanly. Publishing someone's intimate content without consent (including so-called "revenge porn") is prohibited, even if the original recording was consensual.

Deepfakes are prohibited. We don't treat AI use as prohibited in itself -- AI editing and generation tools can be used normally. What's prohibited is using AI to make a real person appear to say or do something they didn't, without their consent (deepfakes, face-swaps, or any synthetic media presented as an authentic recording of a real person).

Also prohibited: content that infringes third-party copyright; content that promotes violence, hate speech, or illegal activity; and content related to prostitution or human trafficking.

How to report. Any user can report content or accounts to security@makefanly.com. We aim to review every report within 5 business days; illegal content or content involving minors is removed immediately, even before the review is complete. Anyone depicted in content can also contest consent; in those cases, the content is preventively removed while we verify consent documentation with the creator. Makefanly may remove content and suspend accounts that violate this policy, with or without prior notice.

You agree not to: (a) attempt to access other users' accounts without authorization; (b) use Makefanly for money laundering or any illicit financial activity; (c) reverse-engineer, copy, or scrape data from the platform in an automated way; (d) resell or redistribute creator content without authorization; (e) use the platform to harass, threaten, or exploit other users.

The Makefanly brand, design, source code and other platform elements (excluding user-submitted content) are owned by Makefanly and protected by law. Nothing in these terms transfers those rights to the user.

Makefanly is provided "as is", with no guarantee of uninterrupted availability, error-free operation, or fitness for a particular purpose. To the maximum extent permitted by law, Makefanly is not liable for indirect damages, lost profits, or losses arising from use of the platform, except in cases of proven intent or gross negligence, or where such limitation is barred by applicable consumer protection law.

We may suspend or terminate accounts that violate these terms. Users may close their own account at any time by contacting support. Amounts already earned from confirmed sales remain owed to the creator, subject to normal holding periods.

We may update these Terms of Service from time to time. Material changes will be communicated by email or an in-app notice with reasonable advance notice. Continued use of Makefanly after a change takes effect constitutes acceptance of the new terms.

Makefanly operates globally but is a Brazilian company. These terms are governed by the laws of the Federative Republic of Brazil, including the Consumer Protection Code where applicable to Brazilian users. For users outside Brazil, disputes will preferably be resolved through amicable agreement or arbitration; absent agreement, the courts of Makefanly's registered jurisdiction apply, without prejudice to mandatory consumer-protection rights of the user's country of residence, where applicable.
